2. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE

By placing an order, the Customer declares that he/she has read the present GTC and accepts them unreservedly. The Customer also acknowledges having received all necessary information and advice from the Company on the Site, enabling him to ensure that the products or services ordered meet his needs. These GCS constitute the entirety of the rights and obligations of the parties in the context of their contractual relationship.

3. DESCRIPTION OF PRODUCTS AND SERVICES

Language: The Products and Services are provided in the French language.

Products on offer :

  • Oracle of Professional Life (printed): Set of 50 cards delivered in a box with brief printed instructions. More detailed digital instructions are available on request or via the secure digital print page.

  • Oracle de la Vie Professionnelle (Digital access) : Password-protected access to a web page featuring a 50-card drawing tool.

Product prices :

  • Printed version: 52 € (excluding postage)

  • Digital version: €15 per year

  • Online conferences

  • Individual and team coaching

  • Training

  • Workshops

4. ORDERS

Product orders are placed exclusively on the oracleviepro.com website.

4.1. Ordering on the Site
After selecting the Product or Service he/she wishes to subscribe to on the Site, the Customer is directed to an order page where he/she enters his/her personal details (surname, first name, e-mail address, postal address, telephone number) and payment details (single payment or payment in instalments, method of payment). The Customer is solely responsible for the accuracy of the information provided and guarantees the Company against any false identity. The Customer shall not hold the Company liable for any failure resulting from the inaccuracy or falsity of the information provided at the time of the Order, which will be used to deliver the Product or Service.

4.2. Order validation
Once the Customer has read and accepted the General Terms and Conditions by ticking the appropriate box, he/she is directed to an Order summary page, where he/she provides his/her bank details before confirming payment. It is the Customer’s responsibility to check the order summary information and correct it if necessary, before confirming payment for the Order. This second click definitively confirms the Customer’s order. The Customer must have a functional electronic mailbox. Otherwise, he/she will not be able to receive written confirmation of his/her order at the e-mail address provided, nor receive his/her access codes to the Service where applicable.

4.3. Order Confirmation
As soon as payment has been validated by the Company or its payment service provider, the Customer will receive an e-mail confirming and summarizing the Order.

4.4. Please note: The first print run of the Oracle of Professional Life is open for orders from September 16, 2024. It will be dispatched between November 5, 2024 and December 20, 2024.

5. PAYMENT

Accepted means of payment are :

  • Credit card

  • PayPal

6. DELIVERY

6.1. Delivery charges
Delivery charges are indicated at the time of ordering and must be paid immediately.

6.2. Stock availability
Products are delivered while stocks last. In the event of unavailability, the customer will be informed and will be able to choose an equivalent product or a refund.

6.3. Carrier
Deliveries are made by an independent carrier, generally COLISSIMO, to the address provided by the customer.

6.4. Ownership and risks
Ownership of the product is transferred to the customer upon full payment. The risks are transferred to the customer as soon as the product is handed over to the carrier.

6.5. Delivery times
The company undertakes to deliver within a maximum of 30 days, unless otherwise specified. Delivery times may vary according to delivery conditions.

6.6. Delay in delivery
In the event of delay, the customer may cancel the contract after requesting the company to carry out delivery within a reasonable additional period. The company will then refund the sums paid within 14 days.

6.7. Product status
The customer must check the condition of the product on delivery and express any reservations if necessary.

7. RIGHT OF WITHDRAWAL

7.1. Delay
The Customer may withdraw without giving any reason within 14 calendar days of ordering a Service or receiving a Product. If this period expires on a Saturday, Sunday or public holiday, it will be extended to the next working day.

7.2. Exercise
To exercise the right of withdrawal, the customer must notify his decision by email to hello@practeez.com.

7.3. Product return
The Customer must return the Product no later than 14 days after having notified his retraction, at the Customer’s expense. The refund will be made within 14 days of receipt of the product.

7.4. Exclusions
The right of withdrawal does not apply to services fully performed before the end of the withdrawal period with the express agreement of the consumer.

8. RETURN CONDITIONS

8.1. Address
Products should be returned to the following address: Practeez, 187 chemin de l’Anversis, 39310 Lamoura. The Customer must enclose a copy of the order confirmation and the withdrawal form or any other unambiguous statement.

8.2. Status
Products must be returned in their original packaging. Any damaged or incomplete product will not be accepted for return or refund.

8.3. Return shipping costs
Return shipping costs are at the Customer’s expense.

8.4. Refund
Reimbursement will be made after receipt and verification of the returned product, excluding delivery costs (unless otherwise stated). In the case of partial returns, delivery charges will be refunded on a pro rata basis.

9. PRODUCT USE

The Oracle of Professional Life is designed as a tool for personal reflection and professional development. Although this oracle may inspire new ideas or perspectives, the user remains in full control of his or her decisions and actions. It is imperative that each user exercises critical thinking and discernment in interpreting the cards.

Practeez and its co-authors cannot be held responsible for any decisions, actions or consequences arising from the use of the oracle. This tool is provided for guidance and inspiration, and should not be construed as professional advice or prediction.

10. INTELLECTUAL PROPERTY

The Company and its Partners hold all intellectual property rights to the Site, the Services and the Platform, including all content (text, images, videos, graphics, logos, sounds, software, etc.).

Access to the Site, Services and Platform does not confer any property rights on the User or Customer. Any reproduction, modification, publication or use of these elements without prior authorization is prohibited and may give rise to legal action, including for infringement.

In return for payment, the Customer obtains a personal, non-transferable and non-exclusive right of use for the duration of the subscribed Service. Any unauthorized transfer or communication of this content is the responsibility of the Customer and may result in termination of the contract.

The Company’s distinctive signs are protected, and any unauthorized use is liable to prosecution. Failure to respect these rights constitutes serious misconduct justifying termination of the contract at the customer’s expense.

11. PUBLISHER’S LIABILITY

Practeez undertakes to supply a product that complies with the description on the site. However, the company cannot be held responsible for late delivery or damage caused during transport, within the limits of the applicable legal provisions.

12. PROTECTION OF PERSONAL DATA

12.1. Collecting data
The Practeez Company collects and processes its customers’ personal data in compliance with the General Data Protection Regulation (RGPD) and current French legislation. The data collected is necessary to process orders, manage customer relations, and comply with legal and regulatory obligations.

12.2. Purposes of processing
The personal data collected is used for :

  • Process and deliver orders

  • Manage customer relations (order tracking, billing, after-sales service)

  • Send commercial information if the customer has agreed to it

  • Improve the services offered on the oracleviepro.com website

12.3. Data sharing
Customers’ personal data is not shared with third parties, unless this is necessary to process the order.

13. CHANGES TO THE GENERAL TERMS AND CONDITIONS OF SALE

Practeez reserves the right to modify these GTC at any time. The applicable GCS are those in force at the date of the order placed by the customer.

14. APPLICABLE LAW AND DISPUTES

These terms and conditions are governed by French law. In the event of a dispute, the parties shall seek an amicable solution before taking any legal action. If an amicable solution cannot be found, the French courts will have jurisdiction to settle the dispute.

14.1 Amicable settlement
In the event of a dispute, the Customer shall first contact the Company to try to find an amicable solution.

14.2. Mediation
In the event of difficulty in the application of the present contract, the consumer customer residing in Europe has the possibility, before any legal action, of requesting recourse to any consumer mediator identifiable on the site https://www.economie.gouv.fr/mediation-conso. The mediator will attempt, independently and impartially, to bring the parties together with a view to reaching an amicable solution.

The parties remain free to accept or refuse recourse to mediation and, in the event of recourse to mediation, to accept or refuse the solution proposed by the mediator. In this context, any European consumer may refer the matter to the Online Dispute Resolution (ODR) platform, accessible at the following URL address: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage.

14.3. Disputes between professionals
In the event of a dispute arising between a professional customer and the company concerning the product or service, the interpretation, performance and/or termination of the contract, exclusive jurisdiction is granted to the courts within the jurisdiction of the company’s head office, notwithstanding multiple defendants or third-party claims, even for emergency proceedings or protective proceedings by way of summary proceedings or petition.
